Especially with sleep this doesnt make much sense that a creature can get out of a stuck condition (pit trap / spider web etc.)

Escape roll is not an Action. It is taken AFTER your Action.

I know that. But use logic here: A creature does not need to spend the action marker to do an escape roll, but while trying to escape, they DO something. That can be called action too, other kind of action, that is not mentioned in the posted sentence.

It still not an action. I agree you should not be allowed escape roll when incapacited, but Incapacited need to be updated with "Do not allow escape roll". But escape roll is not an action in game terms.
